These Terms & Conditions govern access to and use of the Operationally Speaking™ Event Planner and related services provided by Operationally Speaking LLC, 15141 Sam Snead Lane, North Fort Myers, Florida 33917.

By creating an account, purchasing access, or using the Operationally Speaking™ Event Planner, you agree to these Terms & Conditions.

About the event planner

The Operationally Speaking™ Event Planner is a web-based planning tool designed to help users test event assumptions, compare scenarios, estimate costs, evaluate space requirements, and identify operational considerations before commitments are made.

The Planner provides estimates, planning guidance, and decision-support information based on information entered by the user.

The Planner does not replace professional judgment, vendor quotations, engineering advice, safety requirements, permitting requirements, legal advice, accounting advice, or other specialized professional services.

Available plans

Current paid access options may include:

14-Day Test Drive — $39

Provides access to the Event Planner for 14 days.

The Test Drive is a standalone purchase. It does not automatically convert into a monthly or annual subscription.

At the end of the 14-day period, access ends unless the user separately chooses to purchase another plan.

Professional — $89 per month

Provides ongoing access to the Event Planner on a monthly subscription basis until cancelled.

Master Class — $699 per year

Provides annual access to the Event Planner and includes the Digital 4th Edition of Operationally Speaking, An Event Operations Guide, as described on the website at the time of purchase.

Current pricing and plan features are displayed on the Plans & Pricing page of the website.

Operationally Speaking LLC may change pricing or plan features for future purchases. Changes will not retroactively alter a completed purchase except where permitted by the applicable subscription terms.

Complimentary and academic access

Operationally Speaking LLC may provide complimentary, educational, demonstration, promotional, or limited-duration access at its discretion.

Complimentary access may have a specified expiration date, does not require payment unless otherwise stated, does not automatically convert to a paid subscription, and may be limited to specific users, classes, institutions, or purposes.

Academic access may be provided through individual user accounts, class codes, or other approved access methods.

User accounts

Users are responsible for providing accurate account information, maintaining the confidentiality of their login credentials, using the Planner only through their authorized account, and preventing unauthorized use of their account.

Accounts may not be shared, sold, transferred, or made available to unauthorized users.

Operationally Speaking LLC may suspend or terminate access if an account is used fraudulently, unlawfully, or in violation of these Terms.

User information and event plans

Users may create and save event plans and may return to those plans later to continue refining their assumptions.

Users are responsible for the accuracy of the information they enter.

Planner outputs depend on the assumptions, quantities, rates, costs, and other information provided by the user. Inaccurate or incomplete information may produce inaccurate or incomplete results.

Users should independently confirm actual vendor pricing, site conditions, regulatory requirements, staffing needs, capacity restrictions, safety requirements, and other operational conditions before making final event commitments.

Estimates and planning guidance

All costs, quantities, space calculations, planning guidance, operational observations, and other Planner outputs are provided for planning and informational purposes.

They are not guarantees of actual event cost, performance, capacity, safety, profitability, regulatory compliance, or event outcome.

Actual results may vary based on local pricing, market conditions, vendor availability, venue conditions, weather, labor requirements, government regulations, event specifications, and other factors.

Intellectual property

The Operationally Speaking™ name, Event Planner, website content, written material, planning methodology, graphics, instructional content, calculations, guidance, and related materials are owned by or licensed to Operationally Speaking LLC except where otherwise stated.

Purchasing or receiving access gives the user a limited right to use the Planner for authorized personal, professional, business, or educational purposes.

It does not transfer ownership of the Planner or its intellectual property.

Users may not, without written permission, copy or reproduce substantial portions of the Planner, redistribute Planner content, resell access, reverse engineer or attempt to extract proprietary software, remove copyright, trademark, or proprietary notices, or use the Planner to create a competing product or service.

Payment processing

Payments for paid Planner access are processed through Paddle, which acts as the authorized Merchant of Record for transactions processed through its platform.

Paddle may handle payment collection, applicable taxes, payment receipts, billing support, subscription processing, refunds, and related transaction services.

Purchases processed through Paddle are also subject to applicable Paddle terms and policies presented during checkout.

Operationally Speaking LLC does not directly store full payment card details processed through Paddle.

Subscription cancellation

Professional monthly and Master Class annual subscriptions may be cancelled through the subscription-management process made available to the customer.

Cancellation stops future renewal charges.

Unless otherwise required by law or stated at the time of purchase, cancellation does not normally create a refund for time already purchased.

Access generally continues through the end of the paid billing period.

The $39 Test Drive does not require cancellation because it does not automatically renew.

Refunds

Refund requests are governed by the Operationally Speaking LLC Refund & Cancellation Policy and any applicable Paddle consumer-protection requirements.

Nothing in these Terms limits rights that cannot legally be waived.

Availability

Operationally Speaking LLC intends to maintain reliable access to the Planner but does not guarantee uninterrupted or error-free operation.

Temporary interruptions may occur because of maintenance, software updates, hosting issues, internet conditions, third-party services, security events, or circumstances outside our control.

Limitation of liability

To the fullest extent permitted by applicable law, Operationally Speaking LLC is not responsible for losses resulting from reliance on estimates, assumptions, calculations, planning guidance, or other Planner outputs.

Users remain responsible for final event decisions and for independently verifying information before making contractual, financial, operational, safety, or regulatory commitments.

Nothing in these Terms excludes liability that cannot legally be excluded.

Changes to these terms

These Terms may be updated periodically.

The current version will be posted on the Operationally Speaking website with its effective date.

Continued use of the service after an update constitutes acceptance of the revised Terms to the extent permitted by law.
